DEADLINES OF THE AVAILABILITY OF BUILDINGS

Public archives have been available since their creation, unless otherwise provided by law.
Materials for which a legal restriction on availability is established may be used only by authorised persons, in accordance with regulations restricting availability.
Public archives containing classified and other secret information shall be accessible after 40 years from their creation, unless otherwise provided by another law.
Material that is not classified, but contains project and technical documentation of protected and military facilities, industrial and infrastructure facilities or information on natural and strategic resources important for the national security of the Republic of Croatia, is available after the expiration of 40 years from its creation.
Such material may, under the prescribed conditions, be put to use before the expiry of the said time limits if the public interest outweighs the interests to be protected or if appropriate data protection measures have been taken.

Availability of archives which contain personal information

Personal data in public archives are available 100 years after the birth of the person to whom they relate or after their death.
If the date of birth and death is not known or its determination would require disproportionate hardship and costs, personal data are available for 70 years from the date of the material.
Before the expiry of these deadlines, the material may be provided for use with appropriate personal data protection measures, including anonymisation where necessary.
Personal data may also be made available before the expiry of the time limits if the use is requested by the data subject or by a person authorised by him or her, if the data have been made available to the public since their creation, are already publicly available or generally known, if the person consents to it or has made it public himself or herself.
A user who considers that the availability of personal data is limited contrary to the Act may submit a reasoned request for termination of the application of technical protection measures.

AVAILABILITY OF CONSTRUCTION BY 30. MAY 1990

Public archives created up to 30 May 1990 are available without restrictions, except for materials containing certain information relevant to national security and materials containing personal data protected by the Act.
Personal data of persons who held public office or who were members or associates of the security services until 30 May 1990 shall be accessible without restriction in the part relating to the performance of that office or service.
The person whose personal data are contained in such material may make a written statement contesting their veracity or completeness. The declaration shall be made available to users together with the material to which it relates.
