• Public archives are considered to be records created through the function and activity of state authority bodies, units of local self-government and administration bodies, public institutions and enterprises, companies derived from former public enterprises, public notaries and other persons performing public service or being vested with public authority. In principle, public archives are available for consultation 30 years after their creation. Archives are available for consultation before the expiry of 30 years if such records have been intended for the public since their creation or if their creator approves it.
  • Public archives containing information relating to defence and international relations, to national security and to economic interests of the state, the disclosure of which would have harmful consequences for national security or national interests of the Republic of Croatia, become accessible for public use 50 years after their creation, unless regulated otherwise by any special statutes.
  • Pubic archives referring to personal data (registers, medical documentation, personal files – including court, tax, financial and similar documents) are available for consultation 70 years after their creation or 100 years after the person concerned was born.
  • Creators whose activities caused the emergence of the public archives are allowed to use them without any restrictions for the purposes they were created for or the purpose for which they served.
  • Private archives are considered archives created through the activities of private corporate bodies or persons, unless they were created in the execution of public duty or public service or unless they are owned by the state, are subject to the same accessibility time valid for public archives, i.e. 30 years after their creation.
  • Exceptionally, accessibility dates and conditions of use of the archives may be defined differently, in accordance with the special terms defined by their creator during the transfer of archives to the archival institution.
  • In the event that, for scientific reasons, usage of archives is required before the expiry of the defined term, the Manager of the State Archives in Pazin may, subject to previous opinion of the Croatian Council on Archives, i.e. its committee in charge of passing opinions on the early accessibility of archives, authorise the use of archives in line with the provisions of the Archives and Archival Institutions Act although the requirements listed hereto have not been met.

 

Reasons for temporary inaccessibility of archives:

  • The archives are damaged and any use could expose them to further danger
  • The archives has undergone professional treatment related with processing, arrangement, restoration or making of security and safety copies
  • The archives have been loaned to another user of the Reading room or have been loaned and are located outside the premises of the State Archives in Pazin
