The international scientific conference Motovun Colloquium was held for the sixth time in a row in Motovun on 16 November. This year's theme was dedicated to the Treaty of Rapallo, concluded in 1920, which, after World War I, gave most of the eastern Adriatic coast to the Kingdom of Italy, and to the three Lateran Treaties, which in 1929 regulated the relationship between the Holy See and the Kingdom of Italy. As both these agreements were applied in today's territory of the Republic of Croatia, the Motovun Colloquium brought together leading experts in this field in order to first clarify the then Adriatic issue and, in addition, the status of Zadar, the Diocese of Krk, Rijeka and Istria as a whole. Since the Motovun Colloquium has always had \u2018two lungs\u2019, canonical and civil dimensions, this time again the effects of these treaties on interstate relations, but also on ecclesiastical order, have been questioned.<\/p>\n

The meeting was opened by prof. dr. sc. Ivan Miloti\u0107 with the welcome address of the host, Mayor of Motovun Tomislav Pahovi\u0107, and Mirela Mrak, mag. iur., director of the State Archives in Pazin who, together with Josip Tur\u010dinovi\u0107, the Municipality of Motovun, the Photographers' Association Fotovun and the Istrian County, is the organizer of Kolokvija.<\/p>\n

The first part of the event was dedicated to the Treaty of Rapallo. The meeting was opened by Doc. dr. sc. Dunja Miloti\u0107 from the Faculty of Law in Zagreb, providing a general insight into the provisions of the Rapallo Treaty, but also into the manner and circumstances of its conclusion, as well as various aspirations within the new Yugoslav state that conditioned the demarcation in Dalmatia, Zadar, the Rijeka area, the Kvarner islands and Istria. For this occasion, she prepared the texts of the relevant acts, from the Treaty of London, through the Treaty of Armistice with Austria-Hungary, the Treaty of Rapallo and the text of the Anti-Habsburg Coalition, as working materials for all participants. The lecture was given by prof. dr. sc. \u017deljko Bartulovi\u0107 from the Faculty of Law in Rijeka, also the leading expert on the issue of Rijeka after World War I. With exceptional precision and keeping to the reality of everyday life, he gave a unique overview of the status of Su\u0161ak, its de facto affiliation and Rijeka in the time of D\u2019Annuzi\u2019s rule. He showed that extraordinary circumstances in specific local circumstances often deviate from general theoretical views on this problem both in historiography and in law. In his presentation, Prof. Danis Visintin touched upon the 1924 trade agreement between the State of SHS and the Kingdom of Italy, providing an introduction to its application, its validity and the areas it regulates. Particularly interesting were the sections on wine traffic, the regime in ports on the eastern coast of the Adriatic and the different tariffs charged for interstate goods traffic. The first part of the conference was concluded by prof. dr. sc. Budislav Vukas Jr. and Dean Borbelj from the Faculty of Law in Rijeka presented the relations between Yugoslavia and Italy through the prism of interstate relations and agreements that they concluded starting from the Treaty of Rapallo and through the Treaty of Peace with Italy of 1947 and the London Memorandum of 1954 to the Treaty of Exceptions of 1975. Very precisely, the two exhibitors analyzed their status in public international law, especially the issue of ratifications and relations that arose on their basis. They also looked at these agreements from the perspective of developing good neighbourly and interstate relations and through the need for constant dialogue.<\/p>\n

The central part of the conference was dedicated to the presentation of the proceedings \"Habsburgs and Istria in Law and History\" from last year's Kolokvi. It was pointed out that this is an extensive scientific work with carefully selected legal-historical and to some extent historical topics covering the key events and milestones that marked the Habsburg rule in Istria from 1374 to 1918. Particularly praised was the appropriate structuring of the collection, the selection of topics, their minute work and contribution to the knowledge of the original legal history of Istria, as well as some other topics such as the Franciscan cadastre, Karl I. Habsburg and others. The collection was published by the State Archives in Pazin, Josip Tur\u010dinovi\u0107 and Pazin and the Municipality of Motovun.<\/p>\n

The second part of the conference was dedicated to the Lateran Treaties. Prof. dr. sc. Budislav Vukas Jr. and Dean Borbelj presented the relationship between the Holy See and the civil state, it as a subject of international law, and then especially the Lateran Treaties. A special topic of this paper was the processing of these contracts in domestic legal literature used in legal education in Croatia, mostly for the subject of public international law. A gallant and quality presentation was given by Zagreb's lawyer Tomislav Sadri\u0107, who spoke about the concept of the Catholic state on the example of the Lateran Treaties and pointed out the difference in meaning between the \"Catholic country\" and the \"Catholic state\". In his presentation, he explained the relationship between ecclesiastical and civil authorities and the changes in these relations and the relations between the Holy See and Italy since the 1920s. Assoc. prof. dr. sc. Ivan Miloti\u0107 from the Faculty of Law in Zagreb analyzed the concrete consequences of the conclusion of the Rapallo and Lateran Treaties on the territory of the Diocese of Krk, especially those islands that belonged to the Kingdom of Italy (Cres, Lo\u0161inj, Susak, Unije, Ilovik, Male and Velika Srakane). In particular, he analyzed the echoes of the Lateran Treaties in the area of Istria with regard to the attention given to the local Church by the Holy See. The meeting concluded with a comprehensive and inspired lecture by Dr. Livio Prodan from Trieste on political, administrative and judicial institutions in Motovun under Italy. Due to the local determinants of this lecture and extensive photo documentation, this lecture went very well and was followed by a long discussion.<\/p>\n

The essence of the Motovun Colloquium consists of discussions that have not been absent this year, in fact, they seem to have been longer, more intense and fruitful than ever before. The conference was concluded by announcing the publication of the proceedings from this year's conference within a year, i.e. for the next colloquium, and the theme of the Colloquium for the next year on the relations between church and state and canon and civil law.<\/p>\n
